Meanwhile, a number of civil organizations including monks have submitted an open memorandum not to fully implement the 13th constitutional amendment without a referendum. In this open memorandum issued on the 28th, Elle Gunawamsa Thero, Secretary of the Patriotic Monks Front Bengamuwe Nalaka Thero, Nationalist Dr. Gunadasa Amarasekara, President of the Movement, Prasanna Lal de Alwis, Attorney Mayura Gunawansa, Darshana Veraduvage, Kanishka Vitarana and R.A.R.N. Rupasingha and the parties have signed.

This memorandum has been addressed to the President, the Prime Minister, the Cabinet and all Members of Parliament, and it has been pointed out that if the 13th Amendment is fully implemented, Sri Lankans will be exploited, the land and resources located in the North East will be directly captured by India, and disunity will occur among the people of the country. It has been stated in this open memorandum that during the full implementation of the thirteenth constitutional amendment, some other ancillary powers including police and land powers will have to be transferred to the provincial councils, which is a strong threat to the state security, territorial integrity, economic sovereignty and development of Sri Lanka.

In the full implementation of this amendment, a separate police force will be created in each province and controlled under a Deputy Inspector General of Police responsible to the Chief Minister, thereby appointing provincial police commissions and imposing severe restrictions on the central government police in exercising their powers locally, this will affect state security and The memorandum points out that it will have an adverse effect on the establishment of the rule of law in the country. The thirteenth constitutional amendment decentralizes land powers and imposes restrictions on the president to make decisions regarding government lands within a province without consulting the provincial council. It also shows that the Provincial Council will be able to take measures independently of the government. The memorandum has accused that the members of the Northern Provincial Council did not do any service to the people living there despite having the governing powers, but they are waiting for the Provincial Council to get full powers to fulfill the contract of exploitation in India without any deficiency. It has been said in this memorandum that the Indian conspiracy to invade the country’s resources and territory has been discussed to be implemented through the provincial council mechanism which is a creation of India.
